L’art. 28 dello Statuto dei lavoratori ha attraversato un cinquantennio di storia del conflitto sindacale italiano. Si tratta di un rimedio ancora attuale, che necessità di un intervento manutentivo alla luce delle trasformazioni del diritto del lavoro. Partendo dalla validità del modello normativo, il saggio individua le criticità per il legislatore in una prospettiva de jure condendo.

This paper examines the social status of amateur athletes in respect of discrimination they may encounter in comparison with professional athletes. It also addresses the issue of the Italian ‘vincolo sportivo’ and correlative violations of EU law on the free movement of workers. Finally, some possible solutions are proposed.

The present work focuses on the EU-Japan Partnership Agreement, whose consolidated text was finalized on December 2017, having regard to the protection of social rights: in this regard a specific attention will be paid to the EPA chapter on trade and sustainable development and to the negotiations of the Investor-state dispute settlement (ISDS) clause, taking into account the current EU approach as formalized in other recent trade agreements.

The contribution examines the recent orientations of the Italian judges, according to which the provision of a forfeiture term, in order to obtain the recognition of some rights, complies with the Italian Constitution. This is provided that the norms that provide for a forfeiture term must be interpreted strictly, because widening their application should infringe the right of defense, acknowledged by article 24 of the Italian Constitution.

Celem artykułu jest określenie wpływu zasady uprzywilejowania pracownika na swobodę kształtowania przez strony stosunku pracy postanowień umów o pracę oraz umów dodatkowych. W artykule zostały przedstawione argumenty uzasadniające tezę, zgodnie z którą mechanizm przewidziany w art. 18 § 2 kodeksu pracy może znaleźć zastosowanie wyłącznie do postanowień umów o pracę, nie obejmuje natomiast swym zakresem nazwanych i nienazwanych umów dodatkowych zawieranych przez strony stosunku pracy. Jednak o nadaniu określonej klauzuli statusu postanowienia umowy o pracę należy rozstrzygać w oparciu o jej treść, a nie umiejscowienie.
